Whereas in all the other Cantons the right to exploit the hydroelectric power belongs to the State (i.e. the canton, in some cases the district or the local community) in Glarus this right belongs to the riparian owner (according to art. 170 of the act to introduce the Swiss Civil Code in the Canton of Glarus). This doctors thesis examines the origin and development of both public and private rules in this domain of law in the context of the development of the modern administrative law. It shows how the public rule has developped on a cantonal level during the 19th century and was established in 1916 by the federal act on the exploitation of hydroelectric power. In 1916, this ancient right to exploit the hydroelectric power of the riparian owner existed only in the Canton of Zug and most notably in the Canton of Glarus, where it had persisted as costumary law and been codified by Johann Jakob Blumer in 1869.
