Die am 10. Dezember 1948 proklamierte "Universal Declaration of Human Rights" ist das bekannteste Dokument zu den Menschenrechten. Es stellt zugleich das Fundament des allgemeinen Menschenrechtsschutzes im Völkerrecht und im Verfassungsrecht der meisten Staaten dar.
Welche Pflichten ergeben sich aus der Menschenrechteerklärung für die Staaten? Hat sie überhaupt eine juristische Verbindlichkeit? Können Menschenrechte eingeschränkt werden? Wie ist das Verhältnis zu den nationalen Grundrechten? Welche Zusammenhänge bestehen zwischen den Artikeln? Das Buch erläutert die Bedeutung der einzelnen Artikel und deren historische Herkunft. Für die Veröffentlichung wurde die Menschenrechteerklärung von Dirk van Gunsteren und Bardo Fassbender neu ins Deutsche übersetzt.

This book presents the full text of the Universal Declaration of Human Rights, adopted by the United Nations General Assembly on December 10, 1948 as the foundation of the international protection of human rights after World War II. This text is accompanied by a new translation of the Declaration into German, by historical and legal explanations of each of the articles, and by other relevant legal texts such as the two International Covenants on Human Rights of 1966 and the European Convention of Human Rights of 1950. The book also includes recollections of Eleanor Roosevelt, the first chairperson of the United Nations Human Rights Commission which drafted the Universal Declaration, under the title "Writing the Universal Declaration of Human Rights", as well as the text of the "Declaration on the sixtieth anniversary of the Universal Declaration of Human Rights", adopted by the General Assembly in December 2008.
Compared to older translations, the new German version entails a number of significant improvements both in style and contentswise. The new translation aims at conveying the epoch-making text of the Universal Declaration in a fresh and more accessible language (especially addressed to young readers) while retaining the exact legal meaning of the original English. The translation was made by Dirk van Gunsteren - who translated into German the works of T. C. Boyle, V. S. Naipaul, Thomas Pynchon, and Philip Roth, among others - and Bardo Fassbender, Professor of International Law at the Bundeswehr University in Munich, who also wrote the historical and legal comments on the articles of the Declaration as well as a general introduction to the genesis, the importance and the impact of the Universal Declaration on the present international law of human rights.
