Abstract
Within the broader debate on the reallocation of authority upward, downward and sideways from central states, the project addresses the shift of governance capacity towards non-state actors. It opts for a perspective that emphasises not only a dispersion of governance but also for a disaggregation into polycentric systems of governance The basic assumption of this view is that governance is best understood if it is broken down into its constituent service activities. According to this view, governance entails the provision of a wide range of services, each of which can be provided by individuals or organizations specializing in the production or provision of that particular service. While scholars of international relations generally assume that the state as a multifaceted and multipurpose organisation provides all aspects of governance, the project is in accord with the view that particular governance services can be - and have routinely been - provided by different formal organizations and informal arrangements at all levels of social aggregation.
Schemes of transnational out-of court conflict resolution, with their mechanisms of norm-creation and dispute settlement, present the starting point for examining patterns of ordering which exist beyond the nation state. It combines a governance perspective which focuses on the contributions made by a variety of actors to transnational political organization, with a law-informed approach which overcomes the distinction between public law as the law of the political process and private law as the law of the economic process.
