Abstract
Under Swiss law so-called contracts for prostitution are considered void as they are contra bonos mores or «immoral» according to article 20 paragraph 1 of the Code of Obligations. Yet, what is considered to offend against common decency is unclear, and the definition of the term «immoral» can change over time. The authors outline how this change has affected court rulings and academia in Switzerland, Germany and Austria. They argue that contracts for prostitution are not contra bonos mores (any more). Such contracts are primarily governed by the provisions on the mandate; it is not necessary to introduce special legislation.

Der sogenannte Sexdienstleistungsvertrag (oder nach älterer Terminologie: Prostitutionsvertrag) ist gemäss geltender Rechtsprechung des Bundesgerichts nichtig, weil er gegen die guten Sitten verstösst. Der Sittenbegriff ist jedoch unbestimmt und unterliegt einem steten Wandel. Der vorliegende Beitrag zeigt auf, wie sich die veränderten Moralvorstellungen in Rechtsprechung und Lehre in der Schweiz, Deutschland und Österreich niedergeschlagen haben. Es wird vertreten, dass der Sexdienstleistungsvertrag nicht (mehr) sittenwidrig ist. Auf ihn ist in erster Linie das Auftragsrecht anzuwenden. Die Notwendigkeit einer neuen gesetzlichen Grundlage wird verneint.

Le contrat de fourniture de prestations d’ordre sexuel (ou selon une ancienne terminologie, le contrat de prostitution) est nul selon la jurisprudence actuelle du Tribunal fédéral, dès lors qu’il est contraire aux mœurs. La notion de mœurs est toutefois une notion vague qui évolue constamment. La présente contribution explique comment les changements de valeurs morales se répercutent dans la jurisprudence et la doctrine en Suisse, Allemagne et Autriche. Les auteurs sont d’avis que le contrat de fourniture de prestations d’ordre sexuel n’est (désormais) plus contraire aux mœurs. Il convient en premier lieu de lui appliquer les règles du contrat de mandat sans qu’il soit nécessaire d’adopter une nouvelle base légale.
